The New Mexico Environment Department (NMED), Office of Natural Resources Trustee, and Attorney General on July 8 amended the state’s lawsuit against the U.S. Department of Defense (DOD) regarding PFAS contamination in and around military communities. The lawsuit was updated to reflect the newly finalized designation of PFOA and PFOS as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act.
Under the amended lawsuit, NMED and its state partners seek from DOD all past and future cleanup costs and natural resource damages at several DOD sites in New Mexico.
